This rise in sick leave abuse by employees means it has become increasingly common for disgruntled employers not only to institute disciplinary action, but also to lodge complaints with the HPCSA against medical practitioners for issuing medical certificates that do not strictly comply with the provisions of the HPCSA’s Ethical Rules of Conduct and/or being too generous in issuing medical certificates.
Since 2007, there have been several dozen instances of medical practitioners being charged and found guilty of unprofessionalconduct related to poor medical certificate practice.
This includes the provisions of section 23 of the Basic Conditions of Employment Act (Act No 75 of 1997), as well as the Rule 16 of the HPCSA’s Ethical Rules of Conduct.
Employees can use the NES to understand their employment entitlements. We recommend you check your own state or territory laws relating to long service leave entitlements.
The national minimum wage and the NES make up the minimum entitlements for employees in Australia. Medical or Doctor’s Certificate A medical certificate is defined as documentary proof of illness from a registered medical practitioner stating that the employee will be/was unfit for work.
When employers work with their employees to establish an award, employment contract, enterprise agreement or other any other registered agreement they can provide terms and agree conditions that are less than the national minimum wage or the requirements as set out under the NES. A medical certificate is generally regarded as irrefutable proof that an employee was legitimately absent from work because of the stated illness or injury.
If you are employed you will need a form SC2 which is available from your employer or If you have been in hospital a sickness certificate should have been issued by the hospital (please make sure that you ask for a sickness certificate whilst you are in hospital).
If for any reason this has not been the case please contact the relevant doctor or department who has recommended your absence.
Please note it is now the responsibility of both the in patient and outpatient departments to issue the certificate.
